Breach of the obligation to coordinate

Stein Frederick Janzon
sfj@byggogprosjektjus.no

The short version

1. Sub-contractors have a duty of coordination in relation to other side contractors and the other contract assistants of the total/general contractor

2. If the subcontractor fails to comply with his coordination obligation, he may become liable for the total/general contractor's expenses as a result of the other side contractors being delayed.

3. The liability is initially limited to 10% of the contract amount, but the limitation does not apply if the subcontractor has acted with gross negligence or intent.

4. If the total/general contractor can claim daymulch for the same ratio that underlies the neglected coordination, he can only claim daymulch.
